Pollsar Privacy Policy

1. General Provisions

1.1. This Privacy Policy (hereinafter — the "Policy") describes how POLLSAR LLC (hereinafter — "Pollsar", "we"), registered in the United States of America (State of Florida), collects, uses, stores, and protects the personal data of users of the Pollsar platform (hereinafter — the "Platform"), available at https://pollsar.com. The Policy applies to all users of the Platform, including survey authors (hereinafter — "Authors") and respondents who take surveys.

1.2. We are committed to protecting your privacy in accordance with applicable laws, including the General Data Protection Regulation (GDPR, EU), the California Consumer Privacy Act (CCPA, USA), as well as other international standards such as PIPEDA (Canada) and LGPD (Brazil).

1.3. Using the Platform means you agree to the terms of this Policy. If you do not agree with the terms, please stop using the Platform.

2. What Data We Collect

We collect the following categories of data:

2.1. Data You Provide

For respondents:

  • Survey responses: information you provide when taking a survey.
  • Contact data in responses: if a survey requests your name, e-mail, phone number, or other information, you provide it through the survey form. The scope of the data requested is determined by the survey's Author, who is responsible for the content of their survey.

For Authors:

  • Registration data: name, e-mail address.
  • Profile data: location, organization (optional).
  • Billing information: organization and billing address details (optional).
  • Contacts and leads: e-mail addresses and other contact data you upload to distribute surveys (on plans where this feature is available). You are responsible for the lawfulness of processing them and for obtaining the necessary consents.
  • Payment data: card payments are handled by our payment providers (e.g., Stripe, PayPal). Pollsar does not store your full bank card details on its servers — we receive only limited information to account for the payment (e.g., a transaction record, card type, and the last digits of the number provided by the payment provider).
  • Survey content: text, structure, and accompanying content, including images, videos, audio files, and logos uploaded by Authors into surveys.

2.2. Data Collected Automatically

  • Technical data: IP address, device type, operating system, browser, time zone, session data.
  • Cookie data: information collected through cookies and pixel tags (details in the Cookie Policy).
  • Interaction data: actions on the Platform (clicks, page views, survey completion).

2.3. Data Received from Third Parties

  • Data from analytics services (e.g., Google Analytics).
  • Data from payment systems (e.g., Stripe, PayPal) to process Authors' payments.

3. How We Use Your Data

We use your data for the following purposes:

  • Operating the Platform:
    - For respondents: receiving and processing the responses to surveys you take.
    - For Authors: creating and distributing surveys, providing analytics, processing payments.
  • Personalization:
    - Adapting the interface and settings to your preferences.
  • Analytics:
    - Analyzing use of the Platform to improve its operation (e.g., via Google Analytics).
  • Security:
    - Protecting against fraud and ensuring data security.
  • Notifications:
    - Sending e-mail notifications about new surveys, updates, or analytics (with the option to unsubscribe).
  • Legal compliance:
    - Fulfilling legal obligations, including requests from government authorities.

4. Legal Bases for Processing Data

We process data on the following bases:

  • Your consent: For example, when registering or accepting cookies.
  • Performance of a contract: To provide services (e.g., access to surveys and analytics).
  • Legitimate interests: To improve the Platform and ensure security, where this does not infringe your rights (e.g., fraud prevention).
  • Legal obligations: To comply with laws (e.g., tax requirements).

5. Who We Share Your Data With

  • Rights holders or their representatives: As part of handling copyright infringement complaints, in accordance with the DMCA Policy, where this concerns survey content, including images, videos, audio files, logos, text, and URLs uploaded by Authors.

All data transfers are carried out with security measures in place, including encryption and Standard Contractual Clauses (SCC) for GDPR compliance.

We do not sell your personal data and do not share it with third parties for their own marketing purposes. Any data sharing is limited to the purposes described in this Policy.

6. International Data Transfers

Your data may be transferred outside your country (for example, to the USA, where our servers are located). We ensure data protection during international transfers:

  • We use Standard Contractual Clauses (SCC).
  • We apply encryption and other security measures.

7. Data Retention Period

We store data only for as long as necessary for the purposes described in this Policy:

  • Profile data: As long as your account is active or as required by law (after profile deletion — 30 days for recovery, then deletion or anonymization).
  • Survey responses: From 6 months (Free plan) to 3 years (paid plan), then deleted.
  • Billing records: transaction records and invoices are kept for 5 years after the last transaction for tax purposes. Pollsar does not store full bank card details.
  • Cookie data: From 1 hour to 2 years (details in the Cookie Policy).

8. Your Rights

You have the following rights regarding your data:

  • Right of access: Request a copy of your data.
  • Right to rectification: Correct inaccurate data.
  • Right to erasure: Delete data (e.g., delete your profile).
  • Right to restriction of processing: Restrict the use of data.
  • Right to object: Object to processing (e.g., for analytics).
  • Right to data portability: Receive your data in a machine-readable format.
  • Right to withdraw consent: Withdraw consent without affecting the lawfulness of prior processing.
  • Right to lodge a complaint: File a complaint with a data protection authority.

9. How We Protect Your Data

In the event of a data breach, we will notify you and the relevant authorities within the time frames established by law (e.g., 72 hours under the GDPR).

10. Children

10.1. The Pollsar platform is not intended for children under 16. We do not knowingly collect or process the personal data of children under 16. Account registration and paid services are available only to persons aged 18 or older.

11. Third-Party Services

11.1. The Pollsar Platform may share data with third-party services to ensure its operation, as described in Section 5 ("Who We Share Your Data With"). However, the Platform does not use third-party services (such as social media plugins or trackers) that directly collect user data through widgets or embedded elements, unless stated otherwise.

11.2. If you follow links to external resources, their privacy policy may differ from ours. We recommend reviewing their terms before providing any data.

12. Changes to the Policy

12.1. We may update this Policy due to changes in legislation or in our activities. The updated version will be published on the Platform with the effective date indicated.

12.2. We will notify you of significant changes by e-mail or through a notice on the Platform 30 days before the changes take effect.
