Pollsar Privacy Policy

1.1. This Privacy Policy (hereinafter "Policy") describes how POLLSAR LLC (hereinafter "Pollsar", "we"), a company registered in the United States of America (Florida), collects, uses, stores, and protects the personal data of users of the Pollsar platform (hereinafter "Platform"), available at https://pollsar.com. The Policy applies to all Platform users, including respondents and creators (also referred to as "makers").

1.2. We are committed to protecting your privacy in accordance with applicable laws, including the General Data Protection Regulation (GDPR, EU), the California Consumer Privacy Act (CCPA, USA), Federal Law No. 152-FZ "On Personal Data" (Russia), as well as other international standards such as PIPEDA (Canada) and LGPD (Brazil).

1.3. Using the Platform signifies your consent to the terms of this Policy. If you do not agree with the terms, please discontinue using the Platform.

2. What Data We Collect

We collect the following categories of data:

2.1. Data Provided by You

For Respondents:

  • Profile data: age, gender, nationality, education, occupation, interests, and other information provided during registration or in the Respondent Panel.
  • Verification data: name and location (during verification). Photos of documents used for verification are deleted immediately after verification.
  • Survey responses: information provided as part of surveys.
  • Points information: data on earned points and their usage (e.g., for charitable donations or exchanging for coupons).

For Makers:

  • Registration data: name, email address (e-mail).
  • Profile data: location, organization (optional).
  • Billing information: organization and address details for invoicing (optional).
  • Own respondent databases: email addresses provided for survey targeting. You are responsible for their legality.
  • Payment data: information necessary for processing payments (e.g., bank card details).
  • Survey content: text, structure, and accompanying content, including images, videos, audio files, and logos uploaded by makers into surveys.
  • Data on the use of the subscription to current research: information about which research has been viewed (if applicable).

2.2. Data Collected Automatically

  • Technical data: IP address, device type, operating system, browser, time zone, session data.
  • Cookie data: information collected through cookies and pixel tags (details in the Cookie Policy).
  • Interaction data: actions on the Platform (clicks, page views, survey completions).
  • Data on Clicks on Advertising Banners:
    - When clicking on banners placed by makers, the user’s IP address is collected to ensure click uniqueness and prevent click fraud.
    - This data does not contain personal identifying information (e.g., name, email) and is not linked to other personal data.

2.3. Data Obtained from Third Parties

  • Data from analytics services (e.g., Google Analytics).
  • Data from payment systems (e.g., Stripe, PayPal) for processing makers’ payments.
  • Data from charity partners (with respondents’ explicit consent).

3. How We Use Your Data

We use your data for the following purposes:

  • Platform Operation:
    - For respondents: matching surveys, crediting points, access to the Respondent Panel.
    - For makers: creating and targeting surveys, providing analytics, processing payments, placing advertising banners, providing access to current research data.
  • Personalization:
    - Tailoring the experience (e.g., survey recommendations, interface settings).
  • Analytics:
    - Analyzing Platform usage to improve its performance (e.g., via Google Analytics).
    - IP addresses collected from banner clicks are used to generate statistics (e.g., number of clicks, impressions, CTR) provided to makers.
  • Security:
    - Protecting against fraud and ensuring data security, including preventing click fraud on banners.
  • Notifications:
    - Sending email notifications about new surveys, updates, or analytics (with the option to unsubscribe).
  • Legal Compliance:
    - Fulfilling legal obligations, including requests from government authorities.

4. Legal Bases for Data Processing

We process data on the following legal bases:

  • Your Consent: For example, during registration or cookie acceptance.
  • Contract Performance: To provide services (e.g., access to surveys, analytics, banner placement).
  • Legitimate Interests: To improve the Platform and ensure security, provided this does not infringe on your rights (e.g., collecting IP addresses to prevent click fraud).
  • Legal Obligations: To comply with laws (e.g., tax requirements).

5. Who We Share Your Data With

We may share data with the following parties:

  • Rights Holders or Their Representatives: As part of handling copyright infringement complaints, in accordance with the DMCA Policy, if it pertains to the content of surveys or banners, including images, videos, audio files, logos, text, and URLs uploaded by makers.

All data transfers are conducted with security measures, including encryption and Standard Contractual Clauses (SCCs) to comply with GDPR.

Note: IP addresses collected from banner clicks are not shared with third parties, except in cases required by law, and are used solely to generate statistics provided to makers.

6. International Data Transfers

Your data may be transferred outside your country (e.g., to the USA, where our servers are located). We ensure data protection during international transfers:

  • We use Standard Contractual Clauses (SCCs).
  • We apply encryption and other security measures.

7. Data Retention Period

We retain data only for as long as necessary for the purposes outlined in this Policy:

  • Profile data: As long as your account is active or as required by law (after profile deletion — 30 days for recovery, then deletion or anonymization).
  • Survey responses: From 6 months (free plan) to 3 years (paid plan), then deleted.
  • Payment data: 5 years after the last transaction for tax purposes.
  • Cookie data: From 1 hour to 2 years (details in the Cookie Policy).
  • IP Addresses Collected from Banner Clicks: Stored for 24 hours to ensure click uniqueness, then deleted or anonymized.

8. Your Rights

You have the following rights regarding your data:

  • Right to Access: Request a copy of your data.
  • Right to Rectification: Correct inaccurate data.
  • Right to Erasure: Delete your data (e.g., delete your profile).
  • Right to Restrict Processing: Limit the use of your data.
  • Right to Object: Object to processing (e.g., for analytics).
  • Right to Data Portability: Receive your data in a machine-readable format.
  • Right to Withdraw Consent: Withdraw consent without affecting the lawfulness of prior processing.

9. How We Protect Your Data

  • Data Isolation: Respondents’ data (points, surveys) is isolated and inaccessible to other users. IP addresses collected from clicks are stored separately and not linked to other data.

In case of a data breach, we will notify you and the relevant authorities within the legally required timeframe (e.g., 72 hours under GDPR).

10. Children

10.1. The Pollsar Platform is not intended for use by children under 18 years of age. We do not knowingly collect or process personal data from children under 18. If we become aware that a child’s data has been collected, we will immediately delete it from our systems.

11. Third-Party Services

11.1. The Pollsar Platform may share data with third-party services to ensure its operation, as outlined in Section 5 ("Who We Share Your Data With"). However, the Platform does not use third-party services (e.g., social media plugins or trackers) that directly collect user data through widgets or integrated elements unless specified otherwise.

11.2. If you follow links to external resources (e.g., charity websites), their privacy policies may differ from ours. We recommend reviewing their policies before providing data.

12. Changes to the Policy

12.1. We may update this Policy due to changes in legislation or our operations. The updated version will be published on the Platform with the effective date.

12.2. We will notify you of significant changes via email or through a Platform notification at least 30 days before they take effect.
