Pollsar Service Agreement

Effective date: July 1, 2026

1. General Provisions

1.1. This Service Agreement (hereinafter — the "Agreement") governs the provision of services of the Pollsar platform (hereinafter — the "Platform"), available at https://pollsar.com, by POLLSAR LLC (hereinafter — "Pollsar", "we"), registered in the United States of America (State of Florida), to all users of the Platform, including respondents and survey authors (hereinafter — "Authors").

1.2. The Agreement operates together with the Public Offer, the User Agreement, the Privacy Policy, and Pollsar's other applicable documents and form an integral supplement to them. Using the Platform means you agree to this Agreement.

2. Description of Services

2.1. Pollsar provides the following services:

For respondents:

  • Taking surveys created by Authors. Participation is voluntary.

For Authors:

  • Creating surveys, publishing and distributing them (via link, embedding on a website, on social media).
  • Uploading accompanying content into surveys (images, videos, audio files, logos).
  • Targeting and segmenting audiences within the Platform.
  • Access to analytics on survey results.

3. Provision of Services

3.1. Pollsar's Obligations

  • Provide access to the Platform in accordance with the chosen plan and this Agreement.
  • Provide services in accordance with this Agreement and other applicable documents.

3.2. For Authors

  • Access to survey analytics is provided for the duration of the applicable plan.
  • Surveys can be distributed via link, by embedding on a website, and on social media.

3.3. For Respondents

  • Participation in surveys is voluntary.
  • Responses are processed in accordance with the Privacy Policy and the respondents' document available directly within the survey.

4. Obligations of the Parties

4.1. General Obligations of the Parties

  • Users must provide accurate data during registration and use of the Platform.
  • Pollsar and users must comply with applicable law.

4.2. Author's Obligations

  • Ensure the lawfulness of the content of surveys and uploaded materials (images, videos, audio files, logos, text, URLs) and their compliance with applicable rules.
  • Be responsible for claims by third parties related to survey content, including infringement of copyright, trademark rights, and other intellectual property rights. Copyright infringement complaints are handled in accordance with the DMCA Policy.
  • Ensure the lawfulness of processing contact data uploaded to distribute surveys and the availability of the necessary consents.
  • Pay for the chosen plan on time in accordance with the Subscription Terms.

4.3. Respondent's Obligations

  • Provide truthful answers to surveys.
  • Not use the Platform for fraud or other unlawful activities.

5. Paid Services

5.1. The Platform is available on a free plan (Free) and on paid plans (Pro, Expert, Business; Enterprise for organizations), which unlock extended functionality and higher limits. The current composition and cost of the plans are indicated on the "Plans" page. Paid plans renew automatically unless the user cancels the renewal.

5.2. Payment is made through third-party payment systems (e.g., Stripe, PayPal). Pollsar does not store your full bank card details on its servers but may retain billing information (e.g., transaction records and invoices) for invoicing and tax accounting.

5.3. The terms of payment, cancellation, and refunds are governed by the Subscription Terms and the Refund Policy.

6. Limitation of Liability

6.1. Pollsar provides services "as is" and is not liable for:

  • Losses caused by the actions of users, including their infringement of the rights of third parties.
  • Technical failures, interruptions in operation, or data loss, unless caused by intentional actions of Pollsar.
  • The content of surveys created by Authors, including any claims by third parties.
  • Survey results and conclusions drawn from them.

6.2. Pollsar's maximum liability is limited to the amount paid by the user for services over the last 12 months (for Authors) or 100 USD (for respondents), unless otherwise required by mandatory provisions of law.

7. Termination

7.1. Pollsar may discontinue the provision of services in the following cases:

  • Breach by the user of this Agreement or other applicable documents.
  • Suspicion of unlawful activity, including fraud, money laundering, or terrorism financing, in accordance with the AML Policy.
  • Discontinuation of the Platform's operation (with 30 days' notice).

7.2. The user may discontinue the use of services by deleting their account through the Platform's settings. After deletion, data is kept for 30 days to allow for recovery, then deleted or anonymized.

8. Force Majeure

8.1. Pollsar is not liable for failure to fulfill its obligations caused by force majeure circumstances, including natural disasters, wars, terrorist acts, changes in legislation, or internet outages.

9. Governing Law

9.1. This Agreement and the provision of services are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes related to this Agreement are resolved in the courts of the State of Florida, unless otherwise required by the mandatory rules of your jurisdiction.

10. Changes to the Agreement

10.1. Pollsar may update this Agreement due to changes in legislation, operational activities, or the functionality of the Platform. The updated version will be published on the Platform with the effective date indicated.

10.2. We will notify users of significant changes by e-mail or through a notice on the Platform 30 days before the changes take effect.
