1.1. This User Agreement (hereinafter — the "Agreement") governs the use of the Pollsar platform (hereinafter — the "Platform"), available at https://pollsar.com, and the services provided on it by POLLSAR LLC (hereinafter — "Pollsar", "we"), registered in the United States of America (State of Florida). The Agreement applies to all users of the Platform, including respondents and survey authors (hereinafter — "Authors").
1.2. The Agreement operates together with Pollsar's other documents and forms an integral supplement to them, including the Public Offer, the Privacy Policy, the Cookie Policy, the Subscription Terms, the Refund Policy, the DMCA Policy, and the Anti-Money Laundering (AML) Policy. Using the Platform means you agree to this Agreement.
1.3. Use of the Platform is governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes related to this Agreement are resolved in the courts of the State of Florida, unless otherwise required by the mandatory rules of your jurisdiction.

2.2. Certain features are provided on a paid basis as part of a subscription. The terms of paid services are described in Section 4, as well as in the Subscription Terms and the Refund Policy.

4.1. The Platform is available on a free plan (Free), which allows full use within a basic scope, and on paid plans (Pro, Expert, Business; Enterprise for organizations), which unlock extended functionality and higher limits. The current composition and cost of the plans are indicated on the "Plans" page.
4.2. Payment is made through third-party payment systems (e.g., Stripe, PayPal). Pollsar does not store your full bank card details on its servers but may retain billing information (e.g., transaction records and invoices) for invoicing and tax accounting.
4.3. Paid plans renew automatically (monthly or annually depending on the chosen period) unless the user cancels the renewal. The terms of payment, cancellation, and refunds are governed by the Subscription Terms and the Refund Policy.
5.1. Account registration on the Pollsar platform is available to users aged 18 or older; paid services are provided only to users who have reached the age of majority. Participation in surveys as a respondent is governed by a separate document, the Survey Respondent Terms (minimum age — 16).
5.2. If we become aware that an account has been registered by a person under 18, we will block the account and delete the associated data in accordance with the Privacy Policy.
6.1. All rights to the Platform, including software, design, trademarks, and Pollsar's content (except for content created by users), belong to Pollsar.
6.2. The user retains the rights to the content they create (e.g., survey text, images, videos, audio files, logos) but grants Pollsar a non-exclusive licence to store, display, and process it to the extent necessary to provide the services (e.g., showing the survey to respondents, distributing it, and analytics).
6.3. The user undertakes not to use Pollsar's intellectual property without written permission.
7.1. Pollsar provides the Platform and services "as is", without additional warranties other than those expressly stated in this Agreement. We are not liable for:
7.2. Pollsar's maximum liability is limited to the amount paid by the user for services over the last 12 months (for Authors) or 100 USD (for respondents), unless otherwise required by mandatory provisions of law.
8.1. Pollsar is not liable for failure to fulfill its obligations caused by force majeure circumstances, including natural disasters, wars, terrorist acts, changes in legislation, cyberattacks, or internet outages.
9.1. You agree that any disputes related to this Agreement will be resolved on an individual basis. You waive the right to participate in class actions, class arbitrations, or any other form of collective proceedings — to the extent permitted by applicable law.
9.2. If the class action waiver is found to be invalid or unenforceable in your jurisdiction, disputes are resolved in the courts of the State of Florida, as stated in clause 1.3.
10.1. Pollsar may terminate the Agreement in the following cases:
10.2. The user may terminate the Agreement by deleting their account through the Platform's settings. After deletion, data is kept for 30 days to allow for recovery, then deleted or anonymized.
11.1. Pollsar may update this Agreement due to changes in legislation, operational activities, or the functionality of the Platform. The updated version will be published on the Platform with the effective date indicated.
11.2. We will notify users of significant changes by e-mail or through a notice on the Platform 30 days before they take effect. Continued use of the Platform after the changes take effect means your acceptance of the updated Agreement.
