Pollsar Subscription Terms

1. General Provisions

1.1. These Subscription Terms (hereinafter — the "Terms") govern the provision, payment, renewal, and cancellation of subscriptions on the Pollsar platform (hereinafter — the "Platform"), available at https://pollsar.com, for survey authors (hereinafter — "Authors"). This document is an integral part of the Public Offer, the User Agreement, and the Service Agreement.

1.2. POLLSAR LLC (hereinafter — "Pollsar", "we"), registered in the United States of America (State of Florida), provides paid subscriptions for access to extended functionality, higher limits, and additional analytics features, in accordance with the terms set out in this document.

1.3. By purchasing a subscription, you (hereinafter — the "User", "you") agree to these Terms, as well as to the Refund Policy and other applicable documents.

1.4. Subscriptions are intended exclusively for Authors. Respondents use the Platform for free and do not pay for subscriptions.

2. Description of Subscriptions

2.1. Pollsar offers the following plans for Authors:

• Free: The default starter plan. Provides a basic set of features for creating surveys and analyzing responses.
• Pro (paid): Unlocks additional capabilities compared to the Free plan.
• Expert (paid): Provides even more features compared to the Pro plan.
• Business (paid): The maximum set of features for individual Authors.
• Enterprise (paid): Extended capabilities for organizations and teams.

Each subsequent plan (Pro, Expert, Business) expands the available capabilities, including additional analytics and higher limits.

2.2. Paid plans (Pro, Expert, Business, Enterprise) provide access to:

• Extended features and higher limits.
• Additional analytics capabilities.
• Team collaboration with roles (on higher plans).

2.3. The cost of paid plans depends on:

• The chosen plan (Pro, Expert, Business, Enterprise).
• The subscription period: monthly or annual (a discount is provided with annual payment).

2.4. Authors may change their plan (upgrade or downgrade) at any time:

• When upgrading a plan (e.g., from Pro to Expert), access to the new features is provided immediately after paying the difference in cost.
• When downgrading a plan (e.g., from Business to Pro), the change takes effect from the start of the next subscription period, without a refund for the remaining period of the current plan.

The exact cost of each plan is indicated on the "Plans" page and on the Platform before you complete your subscription.

3. Payment Procedure

3.1. Subscription payment is made through third-party payment systems (e.g., Stripe, PayPal). Pollsar does not store your full bank card details on its servers but may retain billing information (e.g., organization name, address, transaction records, and invoices) for invoicing and tax accounting.

3.2. Payment is made at the time of subscribing or changing your plan, in the currency indicated on the Platform at checkout.

3.3. After successful payment, access to the features of the chosen plan is provided immediately. You will receive a payment confirmation at the e-mail you provided.

4. Automatic Subscription Renewal

4.1. Subscriptions to paid plans (Pro, Expert, Business, Enterprise) renew automatically for the next period (monthly or annual) at the end of the current period, unless you have cancelled.

4.2. The renewal amount is charged at the start of the new subscription period. We will notify you in advance of the upcoming renewal and charge by e-mail.

4.3. You can disable automatic renewal in your account settings on the Platform at any time. Cancellation takes effect at the end of the current paid period.

5. Cancellation and Refunds

5.1. You can cancel your subscription at any time through your account settings. Access to the subscription features is retained until the end of the paid period.

5.2. Refunds are possible in the following cases, in accordance with the Refund Policy:

• 14-day money-back guarantee: if you cancel a new paid subscription within 14 calendar days of the first payment and have not used the paid features (e.g., have not created surveys), you can get a refund of the amount paid.
• Automatic renewal: if your subscription renewed automatically and you have not used the new period, you can request a refund within 14 days of the charge.
• Technical failures: if failures on our side prevented use of the services (details in the Refund Policy).
• Plan change: when downgrading a plan, no refund is provided for the remaining period of the current plan, except in the cases set out in the Refund Policy.

5.3. To request a refund, contact [email protected] within 14 days of the relevant payment, providing the transaction details. Mandatory consumer rights (for example, the right of withdrawal in the EU and the UK) are preserved.

6. Changes to the Subscription Terms

6.1. Pollsar may change the price or terms of the subscription (e.g., available features, limits). The updated terms take effect from the start of the next subscription period.

6.2. We will notify you of significant changes by e-mail or through a notice on the Platform 30 days before they take effect. If you do not agree with the changes, you can cancel the subscription before they take effect.

7. Limitation of Liability

7.1. Pollsar is not liable for:

• Failures of third-party payment systems that affect payment or renewal of the subscription.
• Losses related to your late cancellation of the subscription renewal.

7.2. Pollsar's maximum liability is limited to the amount you paid for the subscription over the last 12 months, unless otherwise required by mandatory provisions of law.

8. Governing Law

8.1. These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes related to the subscription are resolved in the courts of the State of Florida, unless otherwise required by the mandatory rules of your jurisdiction.
