Pollsar Subscription Terms

1. General Provisions

1.1. These Subscription Terms (hereinafter "Terms") govern the provision, payment, renewal, and cancellation of subscriptions on the Pollsar platform (hereinafter "Platform"), available at https://pollsar.com, for creators (also referred to as "makers"). This document is an integral part of the Public Offer and Terms of Use.

1.2. POLLSAR LLC (hereinafter "Pollsar", "we"), a company registered in the United States of America (Florida), provides paid subscriptions for access to the Pollsar Audience, advanced features, analytics, and advertising banner placement in accordance with the terms outlined in this document.

1.3. By purchasing a subscription, you (hereinafter "User", "you") agree to these Terms, as well as the Refund Policy and other applicable documents.

1.4. Subscriptions are intended exclusively for makers. Respondents use the Platform for free and do not pay for subscriptions.

2. Description of Subscriptions

2.1. Pollsar offers the following tariff plans for makers:

• Basic (free). The default initial tariff plan. Provides a basic set of features for creating surveys and analyzing responses.
• Pro (paid). Offers additional features compared to the Basic plan.
• Expert (paid). Provides even more features compared to the Pro plan.
• Business (paid). Offers the maximum set of features for makers.

Each subsequent tariff plan (Pro, Expert, Business) expands the available features, including but not limited to access to the Pollsar Audience, analytics, and advertising banner placement.

2.2. Paid tariff plans (Pro, Expert, Business) provide access to:

• The Pollsar Audience (respondent targeting).
• Advanced features.
• The ability to use their own respondent databases.
• Placement of advertising banners in surveys (with prior moderation).

2.3. The cost of paid tariffs depends on:

• The selected tariff plan (Pro, Expert, Business).
• The subscription period:
  - Monthly subscription.
  - Annual subscription (a discount is provided compared to monthly payment).
• For banner placement: the number of paid clicks. Banner placement services are paid separately and are not subject to automatic renewal.
• For access to the audience: the characteristics of the audience and selected parameters.

2.4. Makers can change their tariff plan (upgrade or downgrade) at any time:

• When upgrading (e.g., from Pro to Expert), access to new features is granted immediately upon payment of the cost difference.
• When downgrading (e.g., from Business to Pro), the changes take effect at the start of the next subscription period, with no refund for the remaining period of the current tariff.

The exact cost of each tariff plan and service is indicated on the Platform prior to subscription purchase.

3. Payment Procedure

3.1. Subscription payment is made through third-party payment systems (e.g., Stripe, PayPal). Pollsar does not store your card details but may retain billing information (e.g., organization name, address) for invoicing purposes.

3.2. Payment is made at the time of subscription purchase or tariff plan change. The payment currency is determined based on your region (e.g., USD, EUR).

3.3. Upon successful payment, access to the features of the selected tariff plan is granted immediately. You will receive payment confirmation via the email provided.

4. Automatic Subscription Renewal

4.1. Subscriptions to paid tariffs (Pro, Expert, Business) are automatically renewed for the next period (monthly or annual) at the end of the current period unless you cancel them.

4.2. The renewal amount is deducted 1 day before the end of the current subscription period. You will receive a notification of the upcoming deduction via email 7 days prior to the renewal date.

4.3. You can disable automatic renewal at any time through your account settings on the Platform. Cancellation takes effect at the end of the current paid period.

5. Subscription Cancellation and Refunds

5.1. You can cancel your subscription at any time through your account settings. Access to subscription features remains available until the end of the paid period.

5.2. Refunds are available only in the following cases:

• If you cancel the subscription within the first 7 calendar days from the date of purchase and have not used its features (e.g., did not create surveys, launch targeting, or place banners).
• In case of technical failures that prevent the use of services (details in the Refund Policy).
• When changing tariff plans, no refund is provided for the remaining period of the current tariff, except in cases specified in the Refund Policy.

5.3. To request a refund, contact us at [email protected] within 30 days of the payment date, providing transaction details.

6. Changes to Subscription Terms

6.1. Pollsar may change the cost or terms of subscriptions (e.g., available features, limits). Updated terms take effect at the start of the next subscription period.

6.2. We will notify you of significant changes via email or through a Platform notification at least 30 days before they take effect. If you do not agree with the changes, you may cancel your subscription before they take effect.

7. Limitation of Liability

7.1. Pollsar is not liable for:

• Failures in third-party payment systems affecting subscription payment or renewal.
• Losses related to your failure to timely cancel the subscription renewal.

7.2. Pollsar’s maximum liability is limited to the amount you paid for the subscription over the last 12 months.

8. Applicable Law

8.1. These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Disputes related to subscriptions shall be resolved in the courts of the State of Florida, unless otherwise required by mandatory provisions of your jurisdiction.
