Pollsar DMCA Policy

Effective Date: April 27, 2025

1. General Provisions

1.1. This DMCA Policy (hereinafter "Policy") governs the process for handling complaints regarding copyright infringement related to content posted on the Pollsar platform (hereinafter "Platform"), available at https://pollsar.com, in accordance with the Digital Millennium Copyright Act (DMCA). The Policy applies to all Platform users, including creators (also referred to as "makers"), who upload content (surveys, images, videos, audio files, logos, and other accompanying materials).

1.2. POLLSAR LLC (hereinafter "Pollsar", "we"), a company registered in the United States of America (Florida), is committed to complying with copyright laws and provides users with the opportunity to report alleged infringements through the procedures outlined in this Policy.

1.3. Pollsar operates as a service provider under the DMCA and is not liable for content posted by users, provided it complies with the procedures set forth in this Policy.

2. Notice of Copyright Infringement

2.1. If you are a copyright owner or their authorized representative and believe that content posted on the Platform infringes your copyrights, you may submit a notice of infringement (hereinafter "Notice") in accordance with DMCA requirements.

2.2. The Notice must be sent to Pollsar’s designated agent at the following address: [email protected]

2.3. The Notice must include the following information:

  • A physical or electronic signature of the copyright owner or their authorized representative.
  • A description of the copyrighted work that you claim has been infringed.
  • A description of the location on the Platform (e.g., URL or survey identifier) where the material you claim is infringing is located.
  • Your contact information, including address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the Notice is accurate, and under penalty of perjury (if applicable), that you are the copyright owner or authorized to act on their behalf.

2.4. An incomplete or incorrect Notice may be rejected. Pollsar reserves the right to request additional information to verify your right to file a complaint.

3. Pollsar’s Actions Upon Receiving a Notice

3.1. Upon receiving a valid Notice, Pollsar will take the following actions:

  • Promptly remove or disable access to the material identified in the Notice that is alleged to infringe copyright.
  • Notify the user who posted the disputed content (hereinafter "User") of the receipt of the Notice and the actions taken.

3.2. Pollsar does not participate in resolving disputes between the User and the copyright owner and is not liable for the validity or legitimacy of the Notice.

4. Counter-Notice

4.1. If the User believes that their content was removed or blocked in error or due to misidentification, they may submit a counter-notice (hereinafter "Counter-Notice").

4.2. The Counter-Notice must be sent to the same address: [email protected]

4.3. The Counter-Notice must include the following information:

  • A physical or electronic signature of the User.
  • A description of the material that was removed or to which access was disabled, and its location on the Platform prior to removal.
  • A statement under penalty of perjury that the User has a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  • The User’s contact information, including address, telephone number, and email address.
  • The User’s consent to the jurisdiction of a court in the State of Florida, USA, and acceptance of service of process from the person who submitted the Notice.

4.4. Upon receiving a valid Counter-Notice, Pollsar will:

  • Forward a copy of the Counter-Notice to the person who submitted the Notice.
  • Restore access to the material within 10–14 business days from the date of receipt of the Counter-Notice, unless the person who submitted the Notice informs Pollsar of the filing of a lawsuit against the User.

5. Repeat Infringements

5.1. Pollsar reserves the right to suspend or terminate access to the Platform for users who repeatedly infringe copyrights, in accordance with the Terms of Use.

5.2. A repeat infringement is defined as receiving two or more confirmed Notices of copyright infringement regarding the same user within a 12-month period.

6. Limitation of Liability

6.1. Pollsar is not liable for:

  • The accuracy or validity of Notices or Counter-Notices submitted by parties.
  • Losses related to the removal or restoration of content under DMCA procedures.
  • Actions of users that infringe the copyrights of third parties.
