Pollsar Public Offer

Effective date: July 1, 2026

1. General Provisions

1.1. This Public Offer (hereinafter — the "Offer") is an official proposal by POLLSAR LLC (hereinafter — "Pollsar", "we"), registered in the United States of America (State of Florida), to enter into a contract for the provision of services of the Pollsar platform (hereinafter — the "Platform"), available at https://pollsar.com, with any person (hereinafter — the "User", "you") who accepts the terms of this Offer.

1.2. The Offer is addressed to an unlimited range of persons and operates in accordance with the laws of the State of Florida, USA, as well as applicable international standards, including the GDPR (EU) and CCPA (USA).

1.3. Full and unconditional acceptance of the Offer is registration on the Platform and/or use of its services, including creating an account, taking surveys (for respondents), or creating surveys (for Authors).

1.4. By accepting the Offer, you also agree to the terms of the User Agreement, the Privacy Policy, and the Cookie Policy, which are an integral part of this contract.

2. Subject of the Offer

2.1. Pollsar provides the User with access to the Platform for:

Respondents:

• Taking surveys created by Authors.

Authors:

• Creating surveys, publishing and distributing them (via link, embedding on a website, on social media).
• Targeting and segmenting audiences within the Platform.
• Obtaining analytics on survey results.

2.2. Services are provided on the terms described in this Offer, as well as in the other documents specified in clause 1.4.

3. Rights and Obligations of the Parties

3.1. Pollsar's Obligations

• Provide access to the Platform in accordance with the terms of the Offer.
• Provide services, including access to survey creation, distribution, and analytics, provided that the User complies with the terms of the Offer.
• Protect the User's personal data in accordance with the Privacy Policy.
• Notify the User of significant changes to the terms of the Offer 30 days before they take effect.

3.2. User's Obligations

• Provide accurate data during registration and use of the Platform.
• Comply with the terms of the Offer, the User Agreement, and other applicable documents.
• For Authors:
  - Pay for the chosen plan on time in accordance with Section 4.
  - Ensure the lawfulness of the content of the surveys they create, including text, images, and uploaded materials.
  - Be responsible for the lawfulness of processing contact data uploaded to distribute surveys and for obtaining the necessary consents.
• Not use the Platform for unlawful purposes, including fraud, creating offensive content, or infringing the rights of third parties.

3.3. Pollsar's Rights

• Suspend or terminate the User's access to the Platform in the event of a breach of the terms of the Offer.
• Reject or remove content that violates the law, the rights of third parties, or the terms of the Offer.
• Change the terms of service provision, notifying the User in the manner provided for in clause 3.1.
• Use the User's data in accordance with the Privacy Policy.

3.4. User's Rights

• Use the Platform's services in accordance with the Offer.
• Manage their data in accordance with the Privacy Policy.
• Request a refund in the cases provided for in the Refund Policy.

4. Payment Terms (for Authors)

4.1. Certain Platform features, higher limits, and extended functionality are provided on a paid basis as part of a subscription (the Pro, Expert, and Business plans). The Free plan allows full use within a basic scope. The current composition and cost of the plans are indicated on the "Plans" page. The cost depends on:

• The chosen plan (Pro, Expert, or Business).
• The billing period (monthly or annually).

4.2. Payment is made through third-party payment systems (e.g., Stripe, PayPal). Pollsar does not store your full bank card details on its servers but may retain billing information (e.g., transaction records and invoices) for invoicing and tax accounting.

4.3. Paid plans renew automatically (monthly or annually depending on the chosen period) unless the User cancels the renewal. Cancellation and refund terms are described in the Refund Policy.

5. Limitation of Liability

5.1. Pollsar provides the Platform "as is", without warranties other than those expressly stated in the Offer. We are not liable for:

• Losses caused by the actions of third parties, including failures of third-party services (e.g., payment systems).
• Losses related to the User's breach of the terms of the Offer.
• The content of surveys created by Authors, including any claims by third parties.

5.2. Pollsar's maximum liability is limited to the amount paid by the User for services over the last 12 months (for Authors) or 100 USD (for respondents), unless otherwise required by mandatory provisions of law.

6. Term and Termination of the Contract

6.1. The contract concluded on the basis of acceptance of the Offer is valid from the moment of the User's registration until the deletion of their account or termination of the contract.

6.2. The User may terminate the contract by deleting their account through the Platform's settings. After deletion, data is kept for 30 days to allow for recovery, then deleted or anonymized.

6.3. Pollsar may terminate the contract in the event of:

• The User's breach of the terms of the Offer.
• Discontinuation of the provision of services (with 30 days' notice).

7. Force Majeure

7.1. Pollsar is not liable for failure to fulfill its obligations under the Offer in the event of force majeure circumstances (e.g., natural disasters, wars, changes in legislation). We will notify you of such circumstances and take measures to minimize their consequences.

8. Changes to the Offer

8.1. Pollsar may update this Offer due to changes in legislation or in operational activities. The updated version will be published on the Platform with the effective date indicated.

8.2. We will notify users of significant changes by e-mail or through a notice on the Platform 30 days before they take effect. Continued use of the Platform after the changes take effect means your acceptance of the updated Offer.
