Pollsar Public Offer

Effective Date: April 27, 2025

1. General Provisions

1.1. This Public Offer (hereinafter "Offer") is an official proposal by POLLSAR LLC (hereinafter "Pollsar", "we"), a company registered in the United States of America (Florida), to enter into an agreement for the provision of services on the Pollsar platform (hereinafter "Platform"), available at https://pollsar.com, with any individual or entity (hereinafter "User", "you") who accepts the terms of this Offer.

1.2. The Offer is addressed to an indefinite number of persons and is governed by the laws of the State of Florida, USA, as well as applicable international regulations, including GDPR (EU), CCPA (USA), and Federal Law No. 152-FZ "On Personal Data" (Russia).

1.3. Full and unconditional acceptance of the Offer occurs through registration on the Platform and/or use of its services, including account creation, participation in surveys (for respondents), or creation of surveys (for creators, also referred to as "makers").

1.4. By accepting the Offer, you also agree to the terms of the Terms of Use, Privacy Policy, and Cookie Policy, which form an integral part of this agreement.

2. Subject of the Offer

2.1. Pollsar provides the User with access to the Platform for:

Respondents:

• Participation in surveys provided by makers.
• Submission of profile data, earning points, and using them (e.g., for charitable donations or exchanging for coupons).

Makers:

• Creation and targeting of surveys using the Pollsar Audience or their own respondent databases (email addresses).
• Access to analytics on survey results.
• Placement of advertising banners in surveys on a paid basis with prior content moderation.
• Subscription to current research conducted by Pollsar (subscription is paid separately from tariff plans).

2.2. Services are provided under the terms described in this Offer, as well as in other documents referenced in Section 1.4.

3. Rights and Obligations of the Parties

3.1. Obligations of Pollsar

• Ensure access to the Platform in accordance with the terms of the Offer.
• Provide services, including access to surveys, analytics, the Pollsar Audience, placement of advertising banners, and subscription to current research, subject to the User’s compliance with the Offer terms.
• Conduct preliminary moderation of advertising banners placed by makers to exclude illegal content (e.g., fraud, discriminatory materials, or promotion of prohibited goods or services).
• Protect the User’s personal data in accordance with the Privacy Policy.
• Notify the User of significant changes to the Offer terms at least 30 days before they take effect.

3.2. Obligations of the User

• Provide accurate information during registration and use of the Platform.
• Comply with the terms of the Offer, Terms of Use, and other applicable documents.
• For makers:
  - Timely pay for services in accordance with Section 4, including payment for the placement of advertising banners and subscription to current research.
  - Ensure the legality and compliance with ethical standards of the content of surveys and advertising banners, including images, text, and URLs.
  - Bear responsibility for any third-party claims related to the content of surveys or banners, including violations of copyright or applicable laws.
• Refrain from using the Platform for illegal purposes, including fraud, creating offensive content, or violating third-party rights.

3.3. Rights of Pollsar

• Suspend or terminate the User’s access to the Platform in case of violation of the Offer terms.
• Reject advertising banners if they violate laws, ethical standards, or could be used for illegal purposes.
• Modify the terms of service provision, notifying the User as specified in Section 3.1.
• Use the User’s data in accordance with the Privacy Policy.

3.4. Rights of the User

• Use the Platform’s services in accordance with the Offer.
• Manage their data in accordance with the Privacy Policy.
• Request a refund in cases specified in the Refund Policy.

4. Payment Terms (for Makers)

4.1. Access to the Pollsar Audience, advanced features, subscriptions, placement of advertising banners, and subscription to current research is provided on a paid basis. The cost depends on:

• The size of the audience (number of respondents).
• The number of targeting criteria (e.g., age, nationality).
• The type of respondents (verified, unverified, or mixed).
• The selected tariff plan (monthly or annual).
• For banner placement: the number of paid clicks.
• For subscription to current research: the selected research and its characteristics.

4.2. Payment is made through third-party payment systems (e.g., Stripe, PayPal). Pollsar does not store your card details but may retain billing information for invoicing purposes.

4.3. Tariff plans and subscription to current research are automatically renewed unless canceled by the User. The terms of cancellation and refund are described in the Refund Policy. Subscription to current research is renewed annually. Banner placement services are not subject to automatic renewal.

5. Limitation of Liability

5.1. Pollsar provides the Platform "as is," without warranties beyond those explicitly stated in the Offer. We are not liable for:

• Losses caused by third-party actions, including disruptions in third-party services (e.g., payment systems).
• Losses resulting from the User’s violation of the Offer terms.
• The content of advertising banners placed by makers, including any third-party claims.
• The accuracy or completeness of data provided as part of current research.

5.2. Pollsar’s maximum liability is limited to the amount paid by the User for services over the last 12 months (for makers) or 100 USD (for respondents), unless otherwise required by mandatory legal provisions.

6. Term and Termination of the Agreement

6.1. The agreement concluded upon acceptance of the Offer takes effect from the moment of User registration and remains in force until the User’s account is deleted or the agreement is terminated.

6.2. The User may terminate the agreement by deleting their account through the Platform’s settings. After deletion, data is retained for 30 days for potential recovery, then deleted or anonymized.

6.3. Pollsar may terminate the agreement in the following cases:

• Violation of the Offer terms by the User.
• Cessation of service provision (with 30 days’ notice).

7. Force Majeure

7.1. Pollsar is not liable for failure to fulfill obligations under the Offer due to force majeure circumstances (e.g., natural disasters, wars, changes in legislation). We will notify you of such circumstances and take measures to minimize their impact.

8. Changes to the Offer

8.1. Pollsar may update this Offer due to changes in legislation or operational activities. The updated version will be published on the Platform with the effective date.

8.2. We will notify users of significant changes via email or through a Platform notification at least 30 days before the changes take effect. Continued use of the Platform after the changes take effect signifies your agreement with the updated Offer.
