Pollsar Service Agreement

Effective Date: April 27, 2025

1. General Provisions

1.1. These Terms of Service (hereinafter "Terms") govern the provision of services on the Pollsar platform (hereinafter "Platform"), available at https://pollsar.com, by POLLSAR LLC (hereinafter "Pollsar", "we"), a company registered in the United States of America (Florida), to all users of the Platform, including respondents and creators (also referred to as "makers").

1.2. The Terms are an integral part of the Public Offer, Terms of Use, Privacy Policy, and other applicable documents. Using the Platform signifies your agreement with these Terms.

2. Description of Services

2.1. Pollsar provides the following services:

For Respondents:

  • Participation in surveys provided by makers.
  • Earning points for participating in surveys and using them (e.g., for charitable donations or exchanging for coupons).
  • Option to undergo verification for access to additional surveys.

For Makers:

  • Creation of surveys, including the ability to upload accompanying content (images, videos, audio files, logos), and targeting them to the Pollsar Audience or their own respondent databases (email addresses).
  • Access to analytics on survey results.
  • Placement of advertising banners on a paid basis with prior moderation. Banner placement services are paid based on a click package and are not subject to automatic renewal.
  • Subscription to current research conducted by Pollsar. The subscription is paid separately and renewed annually unless canceled by the user.

3. Service Provision Procedure

3.1. Obligations of Pollsar

  • Pollsar ensures the availability of the Platform in accordance with the selected tariff plan and the Service Level Agreement.
  • Pollsar conducts prior moderation of banners before their placement to exclude illegal content (e.g., fraud, discriminatory materials).
  • Pollsar provides services in accordance with these Terms and other applicable documents.

3.2. For Makers

  • Access to analytics and current research is provided during the subscription term.
  • Banner placement is carried out after successful moderation.

3.3. For Respondents

  • Points are credited after completing a survey.
  • Verification may be required to access certain surveys.

4. Obligations of the Parties

4.1. General Obligations of the Parties

  • Users are required to provide accurate information during registration and use of the Platform.
  • Pollsar and users are obligated to comply with applicable law.

4.2. Obligations of Makers

  • Ensure the legality of the content of surveys and banners, including images, videos, audio files, logos, text, and URLs, as well as their compliance with ethical standards.
  • Bear responsibility for any third-party claims related to the content of surveys or banners, including violations of copyrights, trademark rights, and other intellectual property rights. Pollsar will follow the procedures outlined in the DMCA Policy to handle copyright infringement complaints.
  • Timely pay for services in accordance with the Subscription Terms.

4.3. Obligations of Respondents

  • Provide truthful answers to surveys.
  • Refrain from using the Platform for fraudulent or other illegal activities.

5. Paid Services

5.1. Access to paid services is provided to makers based on tariff plans (Basic, Pro, Expert, Business). Subscriptions to tariff plans are automatically renewed unless canceled by the user.

5.2. The subscription to current research is paid separately from tariff plans and is renewed annually unless canceled by the user.

5.3. Banner placement is paid separately based on a click package and is not subject to automatic renewal.

5.4. Payment and refund terms are governed by the Subscription Terms and the Refund Policy.

6. Limitation of Liability

6.1. Pollsar provides services "as is" and is not liable for:

  • Losses caused by user actions, including violations of third-party rights.
  • Technical failures not related to Pollsar’s actions.
  • The accuracy of data provided as part of current research.

7. Termination

7.1. Pollsar may terminate the provision of services in the following cases:

  • Violation by the user of these Terms or other applicable documents.
  • Suspicions of illegal activities, including fraud, money laundering, or terrorism financing, in accordance with the AML Policy.
  • Cessation of Platform operations (with 30 days’ notice).

7.2. The user may terminate the use of services by deleting their account through the Platform settings. After deletion, data is retained for 30 days for potential recovery, then deleted or anonymized.

8. Force Majeure

8.1. Pollsar is not liable for failure to fulfill obligations due to force majeure circumstances, including natural disasters, wars, terrorist acts, legislative changes, or internet disruptions.

9. Applicable Law

9.1. These Terms and the provision of services are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Disputes related to these Terms shall be resolved in the courts of the State of Florida, unless otherwise required by mandatory provisions of your jurisdiction.

10. Changes to the Terms

10.1. Pollsar may update these Terms due to changes in legislation, operational activities, or Platform functionality. The updated version will be published on the Platform with the effective date.

10.2. We will notify users of significant changes via email or through a Platform notification at least 30 days before they take effect.
